Terms of Service
Effective date: October 6, 2026These Terms of Service ("Terms") govern your use of the website listingstudio.io and the services provided by ListingStudio ("we," "us," or "our"). By placing an order or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services Provided
ListingStudio builds custom single-property listing websites for real estate agents. Our standard service includes a custom-designed, single-page property website built from your provided listing details and photos; registration and configuration of one custom domain name; 12 months of website hosting from the date of delivery; SEO optimization including meta tags, Open Graph data, and a sitemap; and a responsive photo gallery with your property images.
We aim to deliver your completed listing website within 48 hours of receiving your order and all required materials (photos, property details, and listing information). Delivery timelines may vary depending on order volume and completeness of submitted materials.
2. Orders and Payment
All orders are placed through our website and require full payment at the time of submission. The service fee is the price displayed at checkout at the time of purchase, in USD, per listing website. It is a one-time, flat fee. Prices are subject to change, but any price change will not affect orders already placed.
Payment is processed securely through Stripe. By submitting payment, you authorize us to charge the specified amount to your provided payment method. All fees are in U.S. dollars.
3. Refund Policy
If we are unable to deliver your listing website within 7 business days of receiving your complete order (including all required photos and property details), you are entitled to a full refund. Refund requests should be directed to us via email.
Once your listing website has been delivered and is live, refunds are generally not available, as the domain has been registered and the website has been built to your specifications. However, if you are unsatisfied with the delivered website, please contact us and we will work with you to make revisions or resolve the issue.
Domain registration fees paid to the domain registrar on your behalf are non-refundable, as domain registrations cannot be reversed once completed.
4. Domain Registration
As part of our service, we register a custom domain name on your behalf through GoDaddy, our domain registrar. The domain is registered for a period of one year with WHOIS privacy protection enabled. Auto-renewal is not enabled by default.
You are the beneficial owner of the domain. Upon request, we will transfer the domain to your own registrar account at no additional charge. After the initial one-year registration period, domain renewal fees (typically $15–$20/year, set by the registrar) are your responsibility. We will make reasonable efforts to notify you before your domain expires.
Domain name availability is checked at the time of your order but cannot be guaranteed until the registration is complete. If your preferred domain is unavailable at the time of purchase, we will contact you to discuss alternatives.
5. Website Hosting
Your listing website includes 12 months of hosting from the date of delivery. During this period, your site will remain live and accessible at your registered domain. After the initial 12-month hosting period, you may renew hosting for an additional fee. If you choose not to renew, your website will be taken offline, but we will retain your site files for a reasonable period in case you wish to reactivate.
We strive to maintain high uptime for all hosted websites but do not guarantee uninterrupted availability. We are not liable for temporary outages caused by server maintenance, third-party service providers (including Cloudflare, GoDaddy, or our hosting provider), or circumstances beyond our control.
6. Your Content and Responsibilities
You are responsible for providing accurate property information, authorized listing photos, and any other content submitted with your order. By submitting content to us, you represent and warrant that you have the right to use and authorize us to publish all submitted materials, including photos, listing data, and agent branding; the content does not infringe on any third party's intellectual property, privacy, or other rights; the property information is accurate to the best of your knowledge; and you are authorized by your brokerage (if applicable) to market the listed property.
You retain ownership of all content you provide to us. By submitting content, you grant us a limited, non-exclusive license to use, display, and publish that content solely for the purpose of building and hosting your listing website.
7. Our Intellectual Property
The website design, code, templates, layout, and all other elements created by ListingStudio remain our intellectual property. You receive a license to use the completed listing website for its intended purpose (marketing a real estate listing) for the duration of your hosting period.
You may not resell, redistribute, or repurpose our website templates or code. The "Website by ListingStudio" credit in the website footer must remain intact.
8. Acceptable Use
You agree not to use our services for any purpose that is unlawful, fraudulent, or harmful. Listing websites must be used for legitimate real estate marketing purposes. We reserve the right to refuse service or remove any website that contains misleading or fraudulent property information, content that violates any applicable law or regulation, material that infringes on the rights of others, or content that we determine, in our sole discretion, to be objectionable or harmful.
9. Third-Party Services
Our services rely on third-party providers including Stripe (payment processing), GoDaddy (domain registration), Cloudflare (DNS, CDN, and security), Brevo (email delivery), and Dropbox (photo retrieval, when applicable). Your use of our services is also subject to the terms and policies of these providers. We are not responsible for the actions, availability, or policies of third-party services.
10. Limitation of Liability
To the fullest extent permitted by law, ListingStudio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, business opportunities, or goodwill.
Our total liability for any claim arising from or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.
11. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure. We make no warranties regarding the accuracy or completeness of any content on your listing website beyond what you provide to us.
12. Indemnification
You agree to indemnify and hold harmless ListingStudio, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, your content, your violation of these Terms, or your violation of any rights of a third party.
13. Modifications to Terms
We reserve the right to update these Terms at any time. If we make material changes, we will update the effective date at the top of this page. Changes will not apply retroactively to orders already placed. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts located in Walton County, Florida.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ListingStudio regarding your use of our services and supersede any prior agreements or communications.
